1. Who operates this site

This site is operated by Wadam Homes Pty Ltd (ABN 31 696 229 848), trading as Wadam Living ("Wadam", "we", "us", "our"). In these terms, "you" means anyone who visits or uses the site.

2. The site is for information only

The site is here to give you information about Wadam and our homes. It is a starting point for a conversation — not a shop checkout and not a contract.

• Nothing on this site is an offer capable of acceptance. Nothing you see or do here creates a contract to buy, sell, supply, or build anything. A binding agreement is only ever formed through a separate written supply agreement that we and you both sign.
• Product details are indicative and can change. Product availability, models, configurations, specifications, dimensions, inclusions, features, finishes, lead times, and pricing shown on the site are indicative only and may change at any time without notice. Some products described on the site are not yet available for order.
• We try to keep the site accurate and up to date, but we do not promise that everything on it is complete, current, or free of errors.

3. About prices shown as "from"

Where a price appears on the site as a "from" figure, it is an indicative starting point for a particular model in a standard configuration. It is not a quote and not an offer. Your actual price depends on your chosen configuration, your site, delivery, and other site-specific matters, and is confirmed only in a written supply agreement. Prices may change at any time.

4. Images and renders

Photographs, renders, artist's impressions, floor plans, and other imagery on the site are indicative only. They are provided to illustrate a design and may differ from the home you receive. Colours, finishes, styling, landscaping, furniture, and surroundings shown are for illustration and are not included unless a written supply agreement says so.

5. Enquiry and expression-of-interest forms

If you register interest, make an enquiry, or complete any form on the site (including any expression-of-interest or "register your interest" form):

• Making an enquiry or registering your interest costs nothing, and no payment is required to do it.
• Submitting a form does not create any contract or obligation — for you or for us. It simply lets us know you are interested and lets us contact you.
• We handle the personal information you provide in line with our Privacy Policy (see clause 11).

6. Your site, approvals, and on-site work

Homes go onto real land, and every block is different. So:

• Whether a home suits your site, and what approvals it needs, depends on your specific land and your local council or certifier. You are responsible for making your own enquiries and obtaining any approvals, permits, or consents required for your site. We can share general information, but we do not promise that any particular approval will be granted, and information on the site is not site-specific advice.
• Wadam supplies and delivers the home. The on-site works — such as site preparation, footings and foundations, placement, connecting services, and final fix on your block — are carried out by a licensed builder or contractor whom you engage directly. Wadam is not a licensed builder and does not perform or contract those on-site works. The builder you use is engaged by you, under a separate arrangement between you and them.

7. Intellectual property

All content on the site — including text, images, renders, artist's impressions, floor plans, designs, drawings, specifications, logos, and branding — is owned by Wadam or used by us under licence, and is protected by law. You may view and print pages for your own personal, non-commercial use in considering our homes. You must not copy, reproduce, republish, modify, distribute, or use any of it for any other purpose without our prior written permission. The Wadam and Wadam Living names and logos are our trade marks and must not be used without permission.

8. Acceptable use

When using the site, you agree that you will not:

• use it for any unlawful purpose, or in a way that breaches these terms;
• interfere with, disrupt, or attempt to gain unauthorised access to the site or the systems behind it;
• introduce any malicious code, or use any automated system to scrape, harvest, or overload the site; or
• copy or misuse our content in breach of clause 7, or misrepresent your connection with Wadam.

We may suspend or restrict access to the site, or to anyone misusing it, at any time.

9. Links to other websites

The site may contain links to third-party websites for convenience. We do not control those sites and are not responsible for their content, products, or privacy practices. A link is not an endorsement. If you follow a link, you do so at your own risk and subject to that site's own terms.

10. Consumer rights, warranties, and our liability

Our obligations under the Australian Consumer Law come first. Nothing in these terms excludes, restricts, or modifies any consumer guarantee, right, or remedy you have under the Australian Consumer Law or any other law that cannot lawfully be excluded. If we are liable to you under a guarantee that cannot be excluded, our liability is limited to the extent the law allows us to limit it.

Subject to that, the site is provided on an "as is" basis, and — to the maximum extent permitted by law — we are not liable for any loss or damage arising from your use of, or reliance on, the site or its indicative content.

Warranties. Every Elementa home comes with a written warranty. What it covers, the period that applies to each part of the home, and what it excludes are set out in the warranty document and the supply agreement you receive with your home. Where anything on this website describes the warranty in shorter form, the warranty document governs. That warranty is in addition to your rights under the Australian Consumer Law and does not limit them.

11. Privacy

How we collect and handle your personal information is set out in our Privacy Policy, which forms part of your use of the site.

12. Changes to these terms

We may update these terms from time to time. The current version is the one published on this page, and it applies from the effective date shown at the top. Please check back so you know the terms that apply when you use the site.

13. Governing law

These terms are governed by the laws of New South Wales, Australia, and you and we submit to the courts of that State.
